Justice Bernadette Clark ruled July 20 in Supreme Court of the State of New York on the Town of Marshall’s motion regarding the Schachtler Stone Quarry.
In a one-page decision, Clark denied the attempt by the Town, Town’s Zoning Board of Appeals and Codes Officer Dan Ford to add more information for consideration to her March ruling. Both sides presented affidavits in April and June and had oral arguments July 14.
In the spring Clark ruled that the Marshall ZBA had granted quarry owner Eric Schachtler a permit. In that ruling of nearly 50 pages Clark took issue several times with the Town, ZBA and Ford.
No details were provided in her ruling on the denial.
